Acceptable Use Policy

OSHEAN is motivated by its commitment to members to deliver premium, affordable, broadband telecommunications, IP networking, and Above the Net services. It is the mission of OSHEAN to seek out innovative technology solutions that best align with its members’ objectives. Working collaboratively, OSHEAN continuously drives economic advantage and operational efficiency to improve the agility and responsiveness of member organizations.

OSHEAN’s Acceptable Use Policy for OSHEAN services is designed to protect OSHEAN, OSHEAN members and the Internet community in general from irresponsible or, in some cases, illegal activities. Use of these services that is consistent with OSHEAN’s purpose is acceptable.

This policy contains a non-inclusive list of the actions prohibited by OSHEAN. OSHEAN reserves the right to modify the policy at any time, effective upon posting at: http://www.oshean.org/AUP

Prohibited Uses of OSHEAN Network and Services

1. Communications that violate Rhode Island, federal or international laws are unacceptable.

2. Use of the network in a harmful or harassing manner is unacceptable.

3. Transmission, distribution or storage of any material in violation of any applicable law or regulation is prohibited. this included, without limitation, material protected by copyright, trademark, trade secret or other intellectual property right used without proper authorization, and material that is, defamatory, constitutes an illegal threat, or violates export control laws.

4. Sending Unsolicited Bulk Email (“UBE”, “spam”). The sending of any form of Unsolicited Bulk Email through OSHEAN’s servers is prohibited. Likewise, the sending of UBE from another service provider advertising a web site, email address or utilizing any resource hosted on OSHEAN’s servers, is prohibited. OSHEAN accounts or services may not be used to solicit members from, or collect replies to, messages sent from another Internet Service Provider where those messages violate this Policy or that of the other provider.

5. Advertising, transmitting, or otherwise making available any software, program, product, or service that is designed to violate this AUP or the AUP of any other Internet Service Provider, which included, but is not limited to, the facilitation of the means to send Unsolicited Bulk Email, initiation of pinging, flooding, mail-bombing, denial of service attacks.

6. Unauthorized attempts by a user to gain access to any account or computer resource not belonging to that user (e.g., “cracking”).

7. Obtaining or attempting to obtain any OSHEAN service by any means or device with intent to avoid payment

8. Unauthorized access, alteration, destruction, or any attempt thereof, of any information of any OSHEAN, Inc. members or end-users by any means or device.

9. Knowingly engage in any activities designed to harass, or that will cause a denial-of-service (e.g., synchronized number sequence attacks) to any other user whether on the OSHEAN, Inc. network or on another provider’s network.

10. Using OSHEAN Inc.’s Services to interfere with the use of the OSHEAN, Inc. network by other members or authorized users.

OSHEAN Global Network Operations Center (GlobalNOC) will notify member of any known breach of or challenge to the OSHEAN Network potentially affecting them and/or the OSHEAN Network.

Each OSHEAN member is responsible for the activities of its users and by accepting services from OSHEAN is agreeing to ensure that their communities are aware of and abide by this policy. Complaints about prohibited activities on the OSHEAN network will be forwarded to the Member for resolution. If violations of the OSHEAN Acceptable Use Policy occur, OSHEAN reserves the right to take action to stop the offending member from disrupting and affecting the OSHEAN Network as OSHEAN deems appropriate, with or without notice.
